Terms of Service
1. Acceptance of Terms
By accessing or using the MyFixHub platform, website, or mobile applications (collectively, the “Service”), you agree to be bound by these Terms of Service (“Terms”). If you do not agree to these Terms, you may not access or use the Service. These Terms constitute a legally binding agreement between you and MyFixHub Inc. (“MyFixHub,” “we,” “us,” or “our”).
2. Description of Service
MyFixHub is an online platform that connects homeowners and property managers (“Clients”) with licensed, vetted home service professionals (“Pros”). Our Service includes job posting, professional matching, AI-powered pricing estimates, secure escrow payments, verified reviews, and messaging tools. MyFixHub acts as an intermediary platform and is not itself a contractor, employer, or service provider.
3. User Accounts
To use certain features of the Service, you must create an account. You agree to provide accurate, current, and complete information during registration and to keep your account information updated. You are responsible for maintaining the confidentiality of your account credentials and for all activities that occur under your account. You must notify us immediately of any unauthorized access or use of your account. We reserve the right to suspend or terminate accounts that contain false information or violate these Terms.
4. Professional Accounts
Professionals who register on MyFixHub agree to undergo background checks, license verification, and identity verification as part of our trust and safety program. Pros must maintain valid licenses and insurance as required by Ontario law. By creating a Pro account, you represent and warrant that all credentials, certifications, and business information you provide are accurate and current. MyFixHub reserves the right to remove or suspend any Pro account that fails to meet our quality and safety standards.
5. Escrow Payments
MyFixHub offers a secure escrow payment system to protect both Clients and Pros. When a Client approves a quote and authorizes payment, funds are held in escrow by our payment processing partner until the job is completed and the Client confirms satisfaction. Funds are released to the Pro upon job completion approval. Disputes regarding payment or job quality will be handled through our dispute resolution process. MyFixHub charges a service fee on transactions, which is disclosed before payment authorization.
6. Prohibited Conduct
You agree not to engage in any of the following prohibited activities:
- Using the Service for any unlawful purpose or in violation of any applicable laws
- Impersonating another person or entity, or falsifying credentials
- Posting false, misleading, or fraudulent content, reviews, or information
- Circumventing the platform to arrange services or payments outside of MyFixHub
- Harassing, threatening, or intimidating other users
- Attempting to interfere with the proper functioning of the Service
- Scraping, data mining, or using automated tools to collect information from the platform
- Uploading malicious software, viruses, or harmful code
7. Intellectual Property
All content, trademarks, logos, designs, text, graphics, software, and other materials on the Service are the property of MyFixHub or its licensors and are protected by Canadian and international intellectual property laws. You may not reproduce, distribute, modify, or create derivative works from any content on the Service without our prior written consent. User-submitted content (such as reviews, photos, and messages) remains the property of the user, but by posting it on the platform, you grant MyFixHub a non-exclusive, royalty-free, worldwide license to use, display, and distribute such content in connection with the Service.
8. Limitation of Liability
To the fullest extent permitted by applicable law, MyFixHub shall not be liable for any indirect, incidental, special, consequential, or punitive damages, including but not limited to loss of profits, data, or goodwill, arising out of or in connection with your use of the Service. MyFixHub does not guarantee the quality, safety, or legality of services provided by Pros. Our total liability for any claim arising from or related to these Terms or the Service shall not exceed the amount you paid to MyFixHub in the twelve months preceding the claim.
9. Termination
We may suspend or terminate your account and access to the Service at any time, with or without cause, and with or without notice. You may also delete your account at any time through your account settings. Upon termination, your right to use the Service will immediately cease. Provisions of these Terms that by their nature should survive termination shall remain in effect, including but not limited to intellectual property provisions, limitations of liability, and dispute resolution.
10. Governing Law
These Terms shall be governed by and construed in accordance with the laws of the Province of Ontario and the federal laws of Canada applicable therein, without regard to conflict of law principles. Any disputes arising out of or relating to these Terms or the Service shall be resolved exclusively in the courts located in Toronto, Ontario, Canada. By using the Service, you consent to the jurisdiction of such courts.
